These Terms and Conditions govern the provision of man and van, removal, transport and related services by Tooting Man and Van. By making a booking or using our services, you agree to be bound by these Terms and Conditions. Please read them carefully before confirming a booking.
1. Definitions
In these Terms and Conditions, the following words have the meanings set out below:
Customer means the person, firm or company who requests or receives services from Tooting Man and Van.
We, us, our means Tooting Man and Van.
Services means any removal, man and van, transport, loading, unloading, packing, unpacking or related services provided by us.
Goods means any items, belongings, furniture, boxes or property which are the subject of the Services.
Contract means the agreement between the Customer and Tooting Man and Van, incorporating these Terms and Conditions.
Service area means the locations where we agree to provide our Services, generally within the United Kingdom.
2. Scope of Services
We provide man and van and removal services for domestic and commercial customers. Our Services may include collection, loading, transport, unloading and placement of Goods at the agreed destination. Any additional services must be agreed in advance and may incur extra charges.
Our Services do not include packing, dismantling or reassembly of furniture unless this has been expressly agreed at the time of booking. Where such services are provided, they may be subject to an additional charge and limited by the type and condition of the Goods and the property.
3. Booking Process
3.1 A booking is made when you provide us with the required details for your move or transport request and we confirm availability, pricing and the date and time of the Service. Bookings may be made by any communication method we make available from time to time.
3.2 You must provide accurate and complete information, including:
a) Collection and delivery addresses, including any access restrictions.
b) Type, approximate quantity and nature of the Goods.
c) Floor levels, lifts, parking arrangements and any expected difficulties with access.
d) Any special handling requirements for fragile, high value or bulky items.
3.3 Quotes are based on the information you provide. If the actual work involved differs significantly from what was described, we reserve the right to adjust the price accordingly, including additional time, labour or mileage.
3.4 Your booking is not guaranteed until we confirm acceptance. We reserve the right to decline a booking at our discretion.
4. Service Times and Delays
4.1 We will make reasonable efforts to arrive at the agreed start time. However, all times are estimates and may be affected by traffic, weather, road closures, delays in prior jobs or other factors beyond our control.
4.2 If we expect a significant delay, we will use reasonable endeavours to notify you as soon as possible. We are not liable for losses arising from delays or changes to timings that are outside our reasonable control.
4.3 Where delays are caused by you, including but not limited to waiting for keys, access issues or incomplete packing, waiting time may be chargeable at our standard hourly rate or as otherwise agreed.
5. Customer Responsibilities
5.1 You are responsible for ensuring that:
a) Goods are properly packed, secured and prepared for transport, unless packing has been agreed as part of our Services.
b) All items to be moved are ready for collection at the agreed time.
c) The property is safe for our staff to work in, with clear walkways and no unsafe conditions.
d) Suitable parking is available as close as reasonably possible to the property, and that any necessary permits, permissions or authorisations are obtained in advance.
e) You or an authorised representative is present throughout the Service to provide instructions, answer queries and check the completed work.
5.2 You must not ask our staff to carry out any illegal activity or to move any prohibited or unsafe items. We may refuse to move items that, in our reasonable opinion, present a risk to health, safety or property.
6. Items We Do Not Transport
6.1 Unless expressly agreed in writing, we do not transport:
a) Hazardous, flammable, explosive or toxic substances.
b) Illegal goods or items which are not lawfully in your possession.
c) Perishable or temperature-sensitive items requiring special storage.
d) Live animals, pets or plants.
e) Cash, jewellery or other high value items beyond our standard liability limits.
6.2 If you include such items without our knowledge, they will be transported entirely at your own risk and we accept no liability for loss or damage to them, nor for any consequences arising from their transport.
7. Payment Terms
7.1 Prices may be quoted on a fixed price or hourly rate basis. Any quote is based on the information provided at the time of booking and may be subject to change if the actual work differs.
7.2 Unless otherwise agreed, payment is due on completion of the Service on the same day. We reserve the right to require a deposit or full payment in advance for certain bookings.
7.3 Accepted payment methods will be advised at the time of booking. You agree to pay all charges promptly and in full. Where payment is not made when due, we may charge interest on overdue amounts and may withhold further Services until payment is received.
7.4 Any additional work requested on the day, such as extra stops, increased load size or extra labour, will be chargeable at our prevailing rates.
8. Cancellations and Amendments
8.1 If you need to cancel or amend your booking, you must notify us as soon as possible.
8.2 We may apply the following cancellation charges:
a) More than 48 hours before the scheduled start time: no cancellation fee, although any non-refundable third-party costs may be charged.
b) Between 24 and 48 hours before the scheduled start time: up to 50 percent of the quoted price may be charged.
c) Less than 24 hours before the scheduled start time or on the day of the job: up to 100 percent of the quoted price may be charged.
8.3 If you wish to change the date, time or scope of the Service, we will try to accommodate this but cannot guarantee availability. Changes may result in an adjusted quote or additional charges.
8.4 We reserve the right to cancel a booking at any time due to circumstances beyond our control, safety concerns, non-payment or if we reasonably believe that you are in breach of these Terms and Conditions. In such cases, our liability will be limited to refunding any sums you have paid in advance for Services not yet provided.
9. Access, Parking and Restrictions
9.1 You are responsible for ensuring that adequate parking is available for our vehicle at both collection and delivery addresses. Any parking charges, fines or penalties incurred as a direct result of the parking arrangements for your job may be added to your final bill.
9.2 If access is restricted, involving narrow streets, low bridges, limited loading bays, tight staircases or internal restrictions, you must tell us at the time of booking. If we are not advised in advance, additional charges may apply for extra time, equipment or labour required or if we need to use a smaller vehicle.
9.3 Where access is unsafe or unsuitable for our vehicle or staff, we may refuse to proceed or may limit the Service to what we consider reasonably safe.
10. Liability for Loss or Damage
10.1 We will exercise reasonable care and skill in providing our Services. However, our liability for loss or damage to Goods or property is subject to the limitations set out in this section.
10.2 We are not liable for:
a) Loss or damage arising from your failure to pack Goods properly or securely.
b) Loss or damage to items with pre-existing defects, wear and tear or inherent vice.
c) Damage caused by moving Goods against our advice or where you insist on proceeding despite a risk being explained.
d) Loss of sentimental or special value beyond the actual replacement cost of the item.
10.3 Our total liability for any claim arising out of a single job, whether for loss, damage or delay, shall not exceed a reasonable replacement value for the affected items, subject to any applicable statutory rights you may have as a consumer.
10.4 You must notify us of any visible damage or missing items as soon as reasonably practicable and, in any event, within 48 hours of completion of the Service. We may ask for photographs, a description of the damage and proof of value.
10.5 We do not exclude or limit our liability for death or personal injury caused by our negligence, or for any other liability which cannot be limited or excluded by law.
11. Insurance
11.1 We will maintain such insurance cover as we consider appropriate for the Services we provide, in line with industry practice for man and van and removal activities.
11.2 It remains your responsibility to have suitable insurance in place for your Goods during removal or transport. You should check whether your existing home, business or contents insurance covers relocation or transit, and arrange additional cover if necessary.
12. Waste, Disposal and Environmental Regulations
12.1 We are not a general waste disposal company. Any removal of waste, rubbish, construction debris or items intended for disposal must be agreed in advance and may be subject to additional charges and regulatory requirements.
12.2 We will comply with applicable waste carriage and disposal laws and will only dispose of items at authorised facilities. We will not remove or transport hazardous waste or materials that require specialist handling or licensing.
12.3 You confirm that any items you ask us to remove for disposal belong to you and that you have full authority to dispose of them. You remain responsible for any fines, penalties or claims arising from the removal of items where you did not have such authority.
12.4 Fly-tipping or unlawful dumping is strictly prohibited. We will never intentionally dispose of items in any illegal manner. If you request us to act in a way that would breach environmental regulations, we will refuse.
13. Customer Conduct and Safety
13.1 You agree to treat our staff with respect and not to engage in abusive, threatening or aggressive behaviour. We reserve the right to withdraw our Services immediately if we or our staff are subjected to such behaviour, and you may still be liable for all or part of the agreed charges.
13.2 For safety reasons, you must not interfere with the operation of our vehicle or equipment. If you assist with lifting or moving items, you do so at your own risk.
14. Complaints and Dispute Resolution
14.1 If you are unhappy with any aspect of our Service, you should raise the issue with us as soon as possible so that we can try to resolve it promptly.
14.2 We will investigate complaints in good faith and will seek to reach a fair resolution, which may include repair, replacement, a partial refund or other appropriate remedy, depending on the circumstances and our legal obligations.
15. Force Majeure
15.1 We are not liable for any delay, cancellation or failure to perform our obligations where this is due to events beyond our reasonable control, including but not limited to extreme weather, accidents, road closures, breakdowns, strikes, civil unrest or public health emergencies.
15.2 In such circumstances, we may suspend or reschedule the Service without liability, but will use reasonable efforts to agree a new date or refund any amounts paid for Services that cannot be performed.
16. Privacy and Data
16.1 We will collect and use your personal information only as necessary to manage bookings, provide Services, process payments and communicate with you. We will handle personal data in accordance with applicable data protection laws in the United Kingdom.
16.2 By using our Services, you consent to us using your contact details for service-related communication. You may ask us not to use your details for marketing purposes.
17. Changes to These Terms and Conditions
17.1 We may update or amend these Terms and Conditions from time to time. The terms that apply to your booking will be those in force at the time you make the booking, unless a change is required by law or regulatory authority.
18. Governing Law and Jurisdiction
18.1 These Terms and Conditions and any Contract between you and Tooting Man and Van shall be governed by and construed in accordance with the laws of England and Wales.
18.2 You and we agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Services provided.
